Terms of Service

1. Agreement

By creating an account or using AskAround (“the platform”, “the service”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use AskAround. These Terms form a binding agreement between you and AskAround.

2. What AskAround Is

AskAround is a platform that helps users discover service providers through their personal and professional networks. Users can connect with each other, endorse service providers, create community-suggested provider listings, claim and manage provider profiles, and communicate via messaging.

Important: AskAround is a technology platform only. AskAround does not provide the services offered by providers listed on the platform.

  • We do not vet, endorse, certify, license, or guarantee any service provider listed on the platform
  • We do not verify the qualifications, credentials, insurance, or quality of work of any provider
  • Endorsements on the platform are personal opinions of individual users, not endorsements by AskAround
  • We do not guarantee the accuracy of any information provided by users or service providers
  • You are solely responsible for evaluating and selecting any service provider you find through AskAround

You should always do your own due diligence before engaging any service provider, including verifying their qualifications, insurance, references, and suitability for your needs.

3. Eligibility

You must be at least 18 years old to use AskAround. By creating an account, you represent that you are at least 18 years of age and that the information you provide is accurate and complete.

4. Your Account

  • You are responsible for keeping your login credentials secure
  • You are responsible for all activity that occurs under your account
  • You must provide accurate and truthful information in your profile
  • You must not create more than one account per person
  • You must notify us if you suspect unauthorised access to your account

5. Acceptable Use

When using AskAround, you must not:

  • Provide false or misleading information in your profile, service listings, or endorsements
  • Create fake profiles, fake endorsements, or impersonate another person
  • Harass, threaten, abuse, or intimidate other users
  • Send spam, unsolicited promotions, or bulk messages
  • Use the platform for any unlawful purpose
  • Attempt to access other users’ accounts or private data
  • Use automated tools, bots, or scripts to interact with the platform
  • Scrape, copy, or extract platform data without permission
  • Interfere with the operation or security of the platform
  • Post content that is defamatory, obscene, or infringes on others’ rights
  • Attempt to manipulate recommendations or endorsements

We reserve the right to remove content or suspend accounts that violate these rules, without prior notice.

6. Provider Listings

Provider listings may be created by:

  • Providers creating their own profiles
  • Users recommending or adding providers
  • Community-suggested provider listings not yet claimed by businesses

Information displayed in provider listings may be submitted by users of the platform. AskAround does not independently verify all provider information and cannot guarantee the accuracy of provider details.

7. Community-Suggested Providers

Users may add providers to the platform even if the provider has not created an account. These listings may include business names, contact details, service descriptions, and user endorsements or recommendations.

These listings are considered community-generated content. Providers may claim and manage their listing through AskAround’s verification process.

If a provider believes a listing contains inaccurate or inappropriate information, they may contact AskAround to request correction or removal.

8. Recommendations and Endorsements

Recommendations, endorsements, and trust signals displayed on AskAround reflect the opinions, experiences, or relationships of individual users.

AskAround:

  • Does not endorse any specific provider
  • Does not guarantee the quality of services
  • Does not verify every recommendation or endorsement

Users should exercise their own judgment when engaging with service providers.

9. Interactions Between Users and Providers

Any agreement, transaction, or engagement between a user and a service provider is solely between those parties. AskAround is not a party to these interactions and is not responsible for:

  • The quality of services provided
  • Disputes between users and providers
  • Financial transactions between users and providers

10. Messaging and Communication

AskAround provides messaging features between users. You agree not to use messaging features to:

  • Send spam or unsolicited promotions
  • Harass or intimidate others
  • Conduct fraudulent or deceptive activity

AskAround reserves the right to limit, monitor, or suspend messaging features to maintain platform safety.

11. User Content

Your content: You retain ownership of content you post on AskAround, including endorsements, messages, profile information, and service listings.

License to us: By posting content, you grant AskAround a non-exclusive, worldwide, royalty-free license to display, distribute, and use your content as necessary to operate the platform. This license ends when you delete your content or account, except for content that has been shared with other users (e.g., messages already delivered, endorsements already visible).

Your responsibility: You are solely responsible for the content you post. You represent that your content is accurate, does not infringe on anyone’s rights, and does not violate any law.

Our right to remove: We may remove any content that violates these Terms or that we reasonably consider harmful, misleading, or inappropriate, without prior notice.

12. Platform Data and Network Relationships

AskAround organises user relationships, connections, endorsements, and provider discovery results into a network structure.

While users retain ownership of the information they submit, the structure, organisation, and presentation of network relationships, recommendation signals, and aggregated platform data are part of AskAround’s platform and intellectual property.

Users may not copy, scrape, reproduce, or extract this data or network structure for the purpose of building a competing service or database without prior written permission from AskAround.

13. Intellectual Property

The AskAround platform, including its code, design, branding, logos, and documentation, is owned by AskAround. You may not copy, modify, distribute, or reverse-engineer any part of the platform without our written permission.

14. Platform Availability

AskAround aims to keep the service available and functioning properly. However, we do not guarantee uninterrupted or error-free operation. AskAround may:

  • Modify or remove features
  • Perform maintenance
  • Temporarily suspend the service

15. Limitation of Liability

To the maximum extent permitted by law:

  • AskAround is provided “as is” without warranties of any kind, whether express or implied
  • We do not warrant that the platform will be uninterrupted, error-free, or secure
  • We are not liable for the quality, safety, legality, or suitability of any service provider found through the platform
  • We are not liable for any interactions, transactions, disputes, or arrangements between users
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform
  • Our total liability to you for any claim arising from your use of AskAround is limited to the amount you have paid us in the 12 months preceding the claim

Nothing in these Terms excludes or limits any rights you may have under the Australian Consumer Law that cannot be excluded or limited by law.

16. Indemnification

You agree to indemnify and hold harmless AskAround, its operators, and its affiliates from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the platform
  • Content you post on the platform
  • Your interactions with other users or service providers
  • Your breach of these Terms
  • Your violation of any law or third-party rights

17. Account Termination

By you: You may delete your account at any time by contacting us. Upon deletion, your profile and service listings will be removed. See our Privacy Policy for details on data retention after deletion.

By us: We may suspend or terminate your account at any time if you violate these Terms, if we suspect fraudulent activity, or if your activity creates risk for other users or the platform. We will try to notify you, but are not required to do so.

18. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes by updating the “Last updated” date at the top of this page. Your continued use of AskAround after changes are posted constitutes acceptance of the updated Terms.

19. Governing Law

These Terms are governed by the laws of the State of Victoria, Australia. Any disputes arising from these Terms or your use of AskAround will be subject to the exclusive jurisdiction of the courts of Victoria, Australia.
